These terms and conditions govern The Playpen Enterprises LLC Cancellation Policy (the “Cancellation Policy”) available to Charterers and Owners through the Services offered by The Playpen Enterprises LLC. The Playpen Enterprises LLC offers three cancellation options—Flexible, Moderate, and Strict—for all boat listings. Hosts choose one per listing; Charterers may cancel at any time. Fees depend on when cancellation occurs relative to the booking start date/time.
Please note that any weather-related cancellations (named storms, thunderstorms, high winds, etc.) are made at the sole discretion of the Captain or Owner and must be assessed on the day of departure.
Schedule:
Free cancellations until 24 hours before the booking start time.
Cancellations within 24 hours of the booking start time are non-refundable.
For Customer:
More than 24 hours before start:
You’ll receive a full refund less the booking fee (non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.
Within 24 hours of start:
No refund. Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.
Schedule:
Free cancellations until 5 days before the booking start time.
50% refund of boat rental & captain fees for cancellations 3–5 days before start (booking fee non-refundable).
Cancellations within 2 days of the booking start time are non-refundable.
For Customer:
More than 5 days before start:
You’ll receive a full refund less the booking fee (non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.
Between 3–5 days before start:
You’ll receive 50% of boat rental & captain fees (booking fee non-refundable). Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.
Within 2 days of start:
No refund. Any ordered food, beverage, or add-ons are non-refundable and must be picked up as scheduled.
Schedule:
10% booking fee: Non-refundable immediately upon payment.
Free cancellations until 30 days before departure (10% fee retained).
50% refund of booking charges for cancellations 14–30 days before departure (10% fee retained).
No refunds for cancellations within 14 days of departure (10% fee retained).
All cancellations under any policy must be made in writing by emailing charters@theplaypen.com.
As of May 31, 2022, COVID-19–related circumstances are no longer covered for new reservations. Reservations made before that date may qualify for cancellation if you test positive within 5 days of departure; contact us for details.
All provision orders (food & beverage stocking/delivery) must be placed at least 5 days (120 hours) before departure and are non-refundable upon cancellation. Customers must pick up provisions or forfeit refund.
Reschedules incur a fee equal to the original 10% booking fee—unless waived for mechanical failure, Captain no-show, weather-related issues (Captain’s discretion), or vessel inaccessibility. Each request is reviewed individually.
Exceptions (voucher or refund) may be granted for documented events such as:
Named storms within 100 miles on departure day
Safety cancellations for lightning, heavy wind/rain (Captain only)
Natural disasters or political unrest
Mechanical failures causing early termination (pro-rata refund if unremedied within 20% of remaining rental time)
Owner/Captain cancellations or negligence
Material listing inaccuracies
Fraud or safety concerns identified by The Playpen Enterprises LLC
Send documentation to charters@theplaypen.com.
Owners must ensure listings meet standards of accuracy, safety, and cleanliness, and be available to resolve issues for 24 hours post check-in.
The Playpen Enterprises LLC may penalize Owners for cancellations or sub-standard listings by blocking dates, applying fees equal to net income, lowering search ranking, posting cancellation notices, or other remedies.
No Assignment/No Insurance
This Cancellation Policy is not insurance; benefits are non-transferable.
Modification or Termination
We may modify or terminate this policy at any time; changes apply only to future cancellations.
Entire Agreement
This policy supersedes all prior cancellation agreements. Undefined capitalized terms have the meanings given in our Terms of Service.
Controlling Law
This Cancellation Policy will be interpreted under the laws of the State of Illinois and the United States, without regard to conflict-of-law rules.
Limitation of Liability
Our total liability will not exceed the boat fees collected from the Renter. Some jurisdictions may not allow this limitation.
By listing a boat, booking a boat, or using our Services, you agree to this Cancellation Policy.
